Lawcovernotes March 2017

The verifier must take further steps (Clause 10) to verify the identity of the person being identified and/or the identity declarant where they know or ought reasonably to know any of the following: ^ ^ That any identity document produced is not genuine ^ ^ That any photograph on an identity document produced is not a reasonable likeness ^ ^ That the person being identified and/ or the identity declarant does not appear to be the person to which the identity documents relate Extreme caution must be exercised when facing any of the circumstances outlined by Clause 10. The solicitor should advise the identity declarant (preferably in writing) that they are unable to act for them and/or witness their signature because identity cannot be verified to the required standard. Lawcover strongly recommends that solicitors use the Verification of Identity Standard to confirm the identity of all new clients and when witnessing signatures regardless of the type of matter.
