11. ^ ^ When instructed by a client, carefully review the relevant Limitation Act. For matters arising in NSW, refer to Lawcover’s Schedule of Limitation Periods ^ ^ Diarise the limitation period in a shared office calendar and note the relevant date(s) on the front of the file ^ ^ Set an alert/reminder in the calendar for several weeks prior to the limitation period expiry so that you are not caught off guard ^ ^ Confirm the limitation period, the dates by which steps are required to be taken in order to pursue the claim and the risks of not pursuing the claim before the expiry of the limitation period in writing to the client ^ ^ If the limitation period has been missed on instructions by the client, you may be able to seek leave to make an application to commence proceedings out of time ^ ^ Make detailed file notes of all conversations with the client and send detailed advices confirming your instructions.
